OVERVIEW
Welcome to Ultimate Spit Roast Motors. We operate this website and online store to provide customers with information, products, support and purchasing services related to spit roast motors, prongs, stainless components, and related equipment (“the Services”). The website store platform is powered by Shopify. By accessing or using our Services, including placing an order, communicating with us, or browsing our content, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree with these Terms, you should not use our Services.
SECTION 1 — ACCESS & ACCOUNT
You must be the age of majority in your country or region to use our site or make a purchase. You agree that the information you provide (including shipping and billing data) is accurate and that you are authorized to use the payment details supplied. You are responsible for maintaining control of your account if one is created. We are not liable for unauthorized account use resulting from compromised passwords or shared access.
SECTION 2 — OUR PRODUCTS
We do our best to accurately describe and represent our products. However:
● Stainless finishes may vary slightly
● Colors may differ between screen displays
● Photographs may show examples of use or configurations not included in a base purchase
Product specifications may change as we improve or refine designs. We reserve the right to limit the sale of our products to any individual or geographic region at our discretion.
SECTION 3 — ORDERS
When you submit an order, you are making an offer to purchase. We may accept or decline an order at our discretion, including in cases of:
● stock limitations
● pricing errors
● suspected fraud
● shipping limitations
Once an order is accepted and processed, it may not be possible to modify or cancel it. Returns are governed by our Refund & Returns Policy and our Warranty Policy. You agree not to resell our products commercially without written permission.
SECTION 4 — PRICES AND BILLING
Prices may change at any time without notice. Prices shown at checkout are final and binding for that order. Unless otherwise stated, prices do not include postage, GST (if applicable), duties or import fees for international shipments. You agree to provide valid and complete payment details and authorize us to charge the relevant amount to the payment method used.
SECTION 5 — SHIPPING & DELIVERY
We are not responsible for delivery delays due to couriers, customs, weather, or other circumstances outside our control. Once an item is handed to the carrier, risk of loss and responsibility passes to you. We will provide tracking where available.
SECTION 6 — USE OF EQUIPMENT & SAFETY
Many of our products involve heat, motors, electrical operation, and rotating components. You acknowledge that:
● you will use the product in a responsible and safe manner
● you will follow all safety instructions provided
● you will ensure children and untrained persons do not operate the equipment
● you will take care to keep motors dry and protected
We are not liable for injuries or damages resulting from improper use, neglect, exposure to weather/water, or failure to follow proper installation and load balancing.
SECTION 7 — WARRANTY (SUMMARY)
Motors manufactured by Kaimai Forge & Fabrication on or after 01 November 2025 are covered by a 3-year mechanical warranty against manufacturing defects. Motors manufactured before that date by the previous supplier are not covered, but we will assist with paid repair options where feasible. Full warranty terms are available in our Warranty Policy.
SECTION 8 — INTELLECTUAL PROPERTY
All content, product designs, descriptions, images, brand elements and supporting materials are the property of Ultimate Spit Roast Motors or its licensors. You may not copy, reproduce, or distribute our content or designs without written permission.
SECTION 9 — THIRD-PARTY LINKS
Our site may contain links to external sources or references. We are not responsible for the content or safety of those external resources.
SECTION 10 — FEEDBACK & REVIEWS
If you submit feedback, reviews, photos, or usage suggestions, you grant us permission to use that content for promotional or informational purposes. We may moderate or remove inappropriate or abusive content.
SECTION 11 — ERRORS & CORRECTIONS
While we strive for accuracy, mistakes regarding pricing, descriptions, or availability may occur. We reserve the right to correct such errors and cancel or modify affected orders with fair communication.
SECTION 12 — PROHIBITED USES
You agree not to use our Services:
● to engage in fraudulent purchasing or chargeback abuse
● to attempt to reverse-engineer or replicate proprietary product designs
● for illegal or harmful purposes
We reserve the right to refuse service to individuals misusing our products, services, or intellectual property.
SECTION 13 — TERMINATION OF USE
We may suspend or restrict access to the Services if we believe misuse or violation of these Terms has occurred.
SECTION 14 — LIMITATION OF LIABILITY
To the extent permitted by New Zealand law:
● We are not liable for indirect, incidental, or consequential damages
● We are not liable for damage caused by improper installation or misuse
● We are not liable for weather, corrosion, or water damage to motors
Nothing in these Terms excludes rights under the New Zealand Consumer Guarantees Act (CGA) where applicable.
SECTION 15 — GOVERNING LAW
These Terms are governed by the laws of New Zealand. Any disputes shall be handled through New Zealand legal jurisdiction.
SECTION 16 — CHANGES TO TERMS
We may modify these Terms from time to time. Changes take effect when posted on this page.
